These Terms of Use ("Terms") govern your use of QuotePro — The Contractors App (the "App"), published by Forsyth Development LLC, a California limited liability company ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
Apple's licensed application terms
The App is licensed to you, not sold. Your use is also subject to Apple's Licensed Application End User License Agreement (the "Standard EULA"), which is incorporated by reference. If these Terms conflict with the Standard EULA, the Standard EULA controls on the points it covers. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple is not responsible for the App, its maintenance and support, warranty claims, or claims relating to the App (including product liability, legal compliance, consumer protection, and intellectual property claims); those are our responsibility.
License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, for your own business or personal use, as permitted by the App Store rules. You may not copy, modify, reverse engineer, resell, or distribute the App, except as the law allows.
What the App does
QuotePro helps contractors keep customer records, create quotes, contracts, and change orders as PDFs, store job photos and videos, schedule work, and track payments, expenses, and labor. The App does not process payments; payment entries are records you type in.
Your responsibilities
- You are responsible for your content and your business. Prices, quotes, contracts, change orders, signatures, and notes are created by you. Check them before you send them to a customer.
- Not professional advice. The App does not provide legal, tax, accounting, or licensing advice. Templates and totals are tools to help you, and are not a substitute for your own judgment or professional advice. Make sure your documents meet the legal requirements for contractors where you work (including licensing and contract rules).
- Electronic signatures. The App lets you capture a drawn signature. We do not guarantee that a signature captured in the App is legally enforceable in every situation.
- Customer information. You are responsible for handling your customers' information lawfully.
- Backups. Your data is stored on your device and we do not keep a copy. You are responsible for backing it up (for example with iCloud Backup). We cannot recover data that is lost, deleted, or damaged.
Legal compliance and third-party terms
You represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties. You must also follow any third-party terms that apply when you use the App (for example your wireless carrier's terms).
Acceptable use
You agree not to use the App to break the law, to infringe others' rights, to send harmful or deceptive documents, or to attempt to interfere with, disable, or gain unauthorized access to the App or the devices it runs on.
Your content
You keep all rights to the content you enter. We do not receive your content, and we claim no license to it. Because the App operates on your device, nothing you enter is uploaded to us.
Price and purchases
The App's price (including any free download) is shown on its App Store page. Purchases, billing, and refunds are handled by Apple under Apple's terms. If we offer paid features in the future, we will describe them in the App Store listing before you buy.
Updates and availability
We may update, change, or discontinue the App or any feature at any time. Updates may be required to keep using the App. We do not promise that the App will always be available or error-free.
Disclaimer of warranties
To the fullest extent the law allows, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in these Terms limits any rights you have that cannot be limited by law.
Limitation of liability
To the fullest extent the law allows, Forsyth Development LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost business, or disputes with your customers, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim (which may be zero if the App was free). Some places do not allow certain limits, so parts of this section may not apply to you.
Termination
These Terms stay in effect while you use the App. If you break them, your license ends automatically. You can stop at any time by deleting the App.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and the courts located in California have jurisdiction, except where the law of your place of residence requires otherwise.
Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they were last changed. Continuing to use the App after a change means you accept the updated Terms.
Questions and claims
If you have a question, complaint, or claim about the App, contact us at the email below. Apple is not responsible for addressing them.
